On April 20, Beijing Higher People’s Court issued the newly amended “Judgment Guideline” (Chinese, English, and Japanese versions).
The “Judgment Guideline” includes 153 items and 2.1 million words, relating to determination of the scope of patent protection and infringement judgment in invention and utility model, design patent protection scope determination and infringement judgment, and determination of infringement and patent infringement. The Guideline systematically stipulates interpretation of claims, principles, objects, methods of infringement, identification of infringement and defense. For the first time, provisions are provided for the hot issues like patent judicial practice in the standard necessary patent and GUI.
